Former Law Society of Kenya chairman Okong’o Omogeni has dismissed the intrigues surrounding the nomination of David Maraga as the Chief Justice accusing 'dark forces' of being behind a petition seeking to have him rejected for the top job in the Judiciary.

Justice Maraga is facing a dilemma after a petitioner, Fredrick Onyancha, accused him of being responsible for the backlog of cases in Eldoret. He wants the MPs to reject his nomination on this basis.

Two residents from Ainamoi residents had also submitted their petitions even before President Uhuru Kenyatta forwarded Maraga's name to Parliament for vetting.

They accused the judge of giving lenient judgment on the killing of the then MP David Too in January 2008.

The late Too was the brother to the current MP, Benjamin Langat.

But according to Omogeni, the Appellate Judge is being fought by forces from within the Judiciary who were caught by surprise with his nomination.

“I don’t think many people thought he would be nominated for the CJ position and some dark forces are now resisting him. They are looking for all excuses to accuse him despite the outstanding job he has done over the years,” he said.

“Maraga is a Christian and all judgments he has made before were in line with the law. Those accusing him of backlog of cases in Eldoret are not guided by reality. I know the resistance is coming from within because some people are not comfortable with him,” he added.

He, however, maintained that Maraga would overcome the ‘minor’ challenges and take over the realm of the Kenya’s third arm of government.
