Unguja MP Opiyo Wandayi has moved to court to challenge his suspension from the House.
National Assembly Speaker Justine Muturi suspended the MP for breaching Parliamentary rules.
Wandayi was suspended for 11 months from the House following an incident in which opposition MPs blew whistles in Parliament during President Uhuru Kenyatta's state of the nation address.
Mr Wandayi is expected to return to Parliament on February 6, 2017, the official day that the House is expected to commence its fifth and last session.
The current session began on February 9, 2016.
Mr Muturi invoked Standing Order 101, which provides that a member who is physically ejected from the House will stand suspended for the rest of the session.
An MP is paid Sh5,000 as sitting for every sitting.
The House sits four times a week (Tuesday and Thursday afternoons and Wednesday morning and afternoon).
