The duo appeared in court on Monday where they denied engaging in corrupt activities at the expense of the county development.

While appearing before anti-corruption Magistrate Lawrence Mugambi, they insisted that they are innocent.

The governor who surrendered to the EACC headquarters on Sunday after a directive was issued by the DPP appeared in court alongside the wife and two other directors of the company they reportedly colluded with to defraud the county government of the said funds.

Waititu is facing different charges including abuse of office, money laundering, handling suspect property, fraud and conflict of interest among others.

The governor, who was represented by lawyer Prof Tom Ojienda argued that he is a law-abiding citizen, adding that no funds have disappeared from the county government of Kiambu as claimed.

He also said that he observed the procurement procedures when awarding tenders to the different firms.

“There is no reference in the charges stating that any money has been lost in the process. The charges are about the procurement process,” Waititu, through his lawyer submitted, as quoted by Capital FM.

The DPP had said that he has enough evidence against the governor and other accused persons.

The prosecutor told the court that the governor and his wife used the Saika Two Estate Developers Limited to pocket more than Sh25 million from Testimony enterprises Limited Contractor after the latter was awarded a contract by the county government.

The court will on Tuesday make a ruling n whether Waititu and other accused will be released on bail or not.
