A suspected member of the Mombasa Republican Council (MRC) facing charges of murder has been sentenced to hang by a Mombasa High Court.

Mr Faraja Kazungu was accused of killing Police Constable Harrison Maitha Mweni, who was a minister’s bodyguard.

The court heard that the accused, attacked and killed Constable Mweni who was the bodyguard of Kilifi Governor Amason Kingi, on October 4, 2012.

High Court Judge Martin Muya in his ruling found the accused guilty of the murder charge, saying the prosecution had proven its case beyond reasonable doubt.

In the ruling, Judge Muya said military boots and blood-stained clothes belonging to the accused were recovered in his home.

The medical report produced in court indicated that the blood samples taken from the clothes found in the accused person’s home matched the officer’s.

“The accused has been linked and placed at the scene of the crime. The prosecution has proved the case against the accused beyond reasonable doubt,” said Judge Muya.

In the case hearing, State Counsel Jammy Yamina told the court that the accused together with other youth while armed with pangas, stormed a rally that Kingi was addressing.

The officer was killed as he protected Governor Kingi, who was a minister then, from the machete-wielding attackers.

During the attack, local youth descended on the attackers killing three of them on the spot, leaving the accused with injuries.

The accused managed to escape but was later arrested by police officers in his house.
