The county boss in charge of lands Anthony Njaramba on Monday confirmed that the county lawyers were in the process of filing all the documents that will be needed in the suit before officially commencing the legal process against Marwa.

“We want to be categorical that no one is superior to the laws of Kenya; not even Marwa himself. And we are going to sue him for supporting an illegal act using government machinery,”said Njaramba.

Njaramba hinted that after a random check on the disputed land, they had learned that Mr Marwa had ordered that 10 armed police officers guard the workers who were building a perimeter wall around the piece of land largely associated with the Kenya Broadcasting corporation (KBC).

Earlier, Marwa had threatened to arrest the Mombasa governor Hassan Joho for leading a group of rowdy youths to the VOK site and demolishing the wall that was being put up.

Njaramba has however defended the governor saying that he was only exercising his powers as the governor in protecting public land.

"The law is very clear over illegal constructions and it says that they should be demolished and that is exactly what the governor did,” said Njaramba.

This is not the first time that Governor Joho is in a public fight with Marwa.

Early this year, the two were at loggerheads after Marwa ordered the governor to surrender his guns and security personnel, something which didn’t go down well with the county boss.
