Two men were on Thursday arraigned in a Nakuru court over robbery with violence on June 28 at Bahati sub-county.

Kelvin Shilesi and Amos Bosire appeared before Chief Magistrate David Kimei where they were accused of robbing John Maina a shaving machine, wedding ring, smart phone and wrist watch all valued at Sh28000.

The two were said to have been armed with a pistol, clubs and metallic weapons during the incident, charges they denied.

The prosecution had asked for the accused to be detained for four more days at Bahati Police Station to pave way for investigations which their lawyer denied.

“Detaining them four more days amounts to infringement of their constitutional rights. They are entitled to prosecution within 24 hours after the arrest but they stayed more than the time provided for in the constitution,” said their Lawyer David Malanga.

Through their lawyer, the accused challenged the prosecution for delayed investigations saying that the presence of charge sheet shows the investigations were done to come up with the accusations. Malanga applied for a reasonable cash bail saying that the accused will appear in court any time they are needed.

The court ordered Bosire and Shilesi be remanded at Bahati Police Station to allow completion of investigations.
