Former Harambee Stars and Inter Milan midfielder McDonald Mariga on Thursday survived a major battle in Political Parties Tribunal after opponents opted to withdraw a case.
Nine aspirants had sued Jubilee party and Mr Mariga at the tribunal, claiming that no nominations were done before Mr Mariga was declared winner ahead of Kibra by-election.
The party on Monday declared the former footballer the winner and he's set to present papers and the IEBC on Monday next week for clearance.
Peter Morris, one of the aspirants, had initially accused unnamed party officials of allegedly rigging in Mr Mariga, with DP William Ruto believed to have engineered the process.
“To make matters worse, the said selected person is neither a resident nor a voter of Kibra Constituency and there are serious doubts whether or not he has ever voted," he had claimed.
The disgruntled aspirants meet in Nairobi on Thursday and agreed to solve their differences. Deputy President William Ruto is said to have reached out to them.
In a letter through Jacob Oloo Advocates, the nine candidates said they had agreed to withdraw the suit unconditionally after a lengthy meeting.
"We act on behalf of the applicants and we wish to formally inform you that they have unconditionally agreed to withdraw the suit. Jacob Oloo," read the letter.
Mr Mariga will now face Eliud Owalo of ANC, Ramadhan Khamisi of Ford Kenya and an ODM candidate who will be picked on Saturday.
