Renowned lawyer Donald Korir has explained why attempts to incorporate the TJRC, Kriegler and Ndung'u reports in the Building Bridges Initiative (BBI) must be rejected.
According to the flamboyant lawyer, the three reports deal with specific matters which the constitution does not deal with.
"Plot by Anti-BBI Brigade to sabotage BBI Constitution by insisting that TRJC, Kriegler & Ndung’u Reports be made part of it must be rejected ... These Reports were made under existing Commission of Inquiry Act & were specific .... Constitution doesn’t deal with Specific Events, " Donald Kipkorir.
The three reports have never been implemented in full. They touched on electoral malpractices and how they can be avoided in the future in the quest to build a more cohesive society.
The Kriegler, authored by a South African judge, report dealt specifically with the 2007 general elections that plunged the country into a bloodbath.
The TJRC report was handed over in 2013 to President Uhuru Kenyatta by the late commission's chair Bethwel Kiplagat.
How the reports should be implemented or whether they should be implemented at all remain an ongoing question. There are those who have suggested that the reports should be incorporated in the final draft BBI.
