The prosecution has applied for the consolidation of the charges against Sarah Wairimu Kamotho and Peter Karanja as the investigations into the murder of billionaire Tob Cohen gain momentum.

Sarah Wairimu and Mr Karanja were arraigned in court separately but the prosecution wants the cases against the two suspects to be merged, reports the Daily Nation.

In her application, Senior Assistant Director of Public Prosecutions Catherine Mwaniki pleaded with Justice Stella Mutuku to allow the consolidation of the cases. She argued that the victim in the two cases is the same, adding that details of the crime including the time, venue and day are also the same. 

The prosecution further argued that the case will be concluded faster if the accused persons’ charges are merged. 

Lawyer Philip Murgor has, however, objected to the move saying that the case is at a very early stage for the prosecution's application to be granted.

He also said that they are yet to get statements from the witness, which has left them in an awkward position. The lawyer also said that they are yet to be given the exhibits that were used during their trial. Justice Mutuku is expected to deliver a ruling on the application this afternoon.

The body of the deceased was found in a septic tank in his, home in Kitsuru, Nairobi, forty days after he went missing.
