The legal team of former Harambee Stars forward McDonald Mariga appeared before the Independent Electoral and Boundaries Commission (IEBC) on Friday.
Making his submission, renowned lawyer Elisha Ogonya said that the acknowledgement slip that the footballer holds was a confirmation that he was a registered voter as it was issued by the electoral body.
"The complainant is a holder of a voter’s waiting slip as issued by IEBC at the time he was before the returning officer. Upon registration, the slip is issued acknowledging you are registered voter, " Mariga's lawyer told the tribunal.
Mariga, who is vying for the Kibra constituency seat on the governing Jubilee ticket, was disqualified by constituency's returning officer Beatrice Muli this week when he presented his credentials.
Muli argued that the law required her to clear a candidate after confirming that their name was in the IEBC voter register.
Lawyers representing Mariga contend that his name is in the KIEMS kit and the register that was used to disqualify him was not updated.
The acknowledgement slip that the football star has in his possession was allegedly issued in Starehe Constituency at the Kariokor Social Hall where voter registration was ongoing.
Individuals seeking to run for political office are required by law to register as voters first.
