A matatu conductor arraigned before a Kibera Law Court to answer to charges of violating traffic rules has been acquitted.
This is after the conductor, John Kinuthia presented a selfie before the court as evidence to prove that he was wearing his uniform at the time of his arrest.
Kinuthia was being charged alongside others who were facing similar charges of failing to follow traffic rules.
Kinuthia, however, denied the charges before Senior principal magistrate Esther Boke arguing that he was arrested after disagreeing with the police officer over a different issue and not for failing to wear his uniform while at work.
The court heard that Kinuthia was arrested along Waiyaki Way and detained at Kabete Police Station before he was taken to court where he was accused of violation of his dress code as a tout.
Kinuthia said during the incident along Waiyaki Way, he took a selfie with the driver’s phone before he was arrested.
“As the whole incident went on, I requested to talk to the driver and it is at this point I took a selfie with the driver’s phone,” said Kinuthia.
Senior principal magistrate Esther Boke in her ruling acquitted the officer saying that the prosecution failed to provide evidence that the tout was not wearing uniform at the time of the arrest.
