Alice Wanjiru, 70, on Thursday sued a bank for illegally auctioning her property to recover a loan.

According to Wanjiru's lawyer Harrison Kinyanjui, a bank fraudulently auctioned her Sh150 million property. 

Kinyanjui noted that this was after the bank falsely alleged that the widow was unable to repay their Sh65 million loan. 

The case was initially presented to Justice Mary Kasango of the High Court. However, Kasango recused herself from the case. 

Justice David Majanja stepped took over and the case will be heard on November 8. 

Citizen Digital was told that Justice Majanja pushed the case ahead to have enough time to go through the case file and understand it. 

In her application, Waniru indicated that Faulu Microfinance Bank Ltd sold her property to Oksana Investment Supplies Ltd. 

She noted that she had not defaulted on repaying their loan as claimed by the bank. 

The bank, on the other hand, has maintained that auctioning the property was right as the woman had been given a lot of time to repay the loan in vain. 

Oksana Investment Supplies Ltd have also filed a case seeking to evict Alice from the property, which they legally acquired after the sale by public auction.
