Ousted Kisumu County Assembly Speaker Onyango Oloo has suffered a major blow in his ouster case, after a court validated his impeachment by members of the Kisumu County Assembly.

Oloo moved to court in September to challenge his removal and replacement with Elisha Oraro, arguing that he was not allowed to defend himself.

Through his lawyer Muga Apondi, he argued that the assembly infringed on his rights and freedom, adding that the house went against Article 178(1) of the Constitution.

"It is in the interest of justice that this honourable court intervenes at this juncture to arrest the illegality and violations of the constitution and the law,” said the lawyer.

But his argument was dismissed by Employment and Labour Court Judge Justice Nduma Nderi, who said his application lacks merit and is therefore baseless.

He noted that the impeachment was passed by 75 percent of the house members, this being 42 MCAs, in a case where Oloo was impeached over his implication in corruption.

Oloo, a former Kisumu Central parliamentary hopeful, has also been ordered to return any assembly property in his possession.

Oloo has said that he is not contented with the ruling and will be appealing it.
