The UK Supreme court opened proceedings on Tuesday, 17th September, to determine whether Prime  Minister Boris Johnson acted illegally and in bad faith following suspension of parliament.

Mr Johnson suspended parliament after writing to the Queen until October 14th, just two weeks to the important determination over Brexit.

The decision to suspend parliament irked many lawmakers who have termed the move as a ploy to stop  legislators from debating the Brexit terms and largely viewed as a plan by the PM to take the UK out of Europe with or without a deal.

The case has already been heard by UK's two lower courts who gave contradicting positions on the case

England's High court termed the decision to suspend parliament as political and refused to rule on it's legality, while a Scottish High court found that the PM's actions were illegal and only designed “to avoid democratic scrutiny.”

UK's high profiled anti-brexiter, Gina Miller, took to supreme court after the UK high Court termed the move as political. 

While arguing through his laywer, Lord Pannick, Miller said that if left to stand, the PM's decision will set a bad precedent.

According to the CNN, Miller's laywer is quoted as arguing that "We really need to confront he question of what happens if another Prime Minister were to decide that he or she would like to prorogue for six months or a year."

The case is set to continue for at least three days. PM Boris is seeking to have UK withdraw from European Union and he's fighting to beat October 31st deadline.

He replaced Theresa May in June, after she failed to offer a clear guideline on withdrawal. The Conservatives are under pressure from Labour Party to deliver the exit.
