A suspected drug peddler wants a Nakuru Court to release him on bond after the police filed an application to have him detained.
The officers from the Directorate of Criminal Investigations attached to the Anti-Narcotics Unit in Nakuru filed the application seeking to have Joseph Muli Obenjo denied bond.
In a sworn affidavit, Police Constable Benard Leboo told the court that Obenjo who is facing charges of trafficking and selling heroin and other hard drugs to Nakuru residents was recently released on bond.
Leboo said the accused is facing similar charges in a different court and was arrested on July 17 in Bondeni committing the same offence after he was released on bond.
The accused was found in possession of 207 sachets of heroin with a street value of Sh103,500 and 20 tablets of narcotic drug known as Rohypnol worth Sh1,000.
The court further heard that the accused is a flight risk if released saying that the charges he faces attract a huge fine and a lengthy sentence if he is convicted.
“If the accused person is released on bond, he will continue committing the same offense,” said Leboo in the police affidavit as quoted by nation.co.ke.
The accused however through lawyer Steve Kabita objected the police’s application to deny his client bond saying the police failed to provide evidence of the other criminal case of the same nature that his client is allegedly facing.
“The author of the said affidavit has quoted another criminal case in another court. It is illegal to mention an ongoing matter. Furthermore, there is no charge sheet to indicate what charges my client is facing and the status of that matter,” said lawyer Kabita.
The lawyer asked Nakuru Chief Magistrate Josephat Kalo to grant his client reasonable bond terms pending the next case hearing.
Magistrate Kalo will deliver his ruling on the application on July 26.
