The lawmakers will wait until the case challenging their allowance is heard and determined.

The High Court ruled that lawmakers in both the National Assembly and Senate are not entitled to any house allowance until further notice.

While delivering the ruling, the three-bench team said the payment of the lawmakers is still unlawful.

The team comprised of Justice John Mativo, Lady Justice Pauline Nyamweya, and Justice Weldon Korir.

“The status quo will remain in force pending determination of the petition. This means that the orders earlier issued stopping PSC from paying housing allowance to MPs are still in force,” said Justice Nyamweya as quoted by Standard.

Activist Okiya Omtata and the Salaries and Remuneration Commission had moved to court challenging the push for the allowances.

The judges have since ordered for the consolidation of the cases of the two sides pending the hearing of the same before the fate of the lawmakers is determined.

SRC has objected the move by the legislators to award themselves an allowance of Sh250, 000 monthly house allowance.
