Mr McDonald Mariga was on Tuesday rejected by IEBC over claims that his name was not appearing in the voter register, and he has since appealed.

Returning officer Jane Muli said: “We have invalidated Mariga’s nomination to vie in the Kibera by-election because his name is not on the voter’s register.”

The former footballer had expressed interest in the Kibra seat, which was declared vacant following the death of Ken Okoth. He was accompanied by Dr Boni Khalwale during handing over of certificates to IEBC.

But Mr Raila Junior took a swipe at the two, over an incident where Khalwale seemed to prevent the former Harambee Stars midfielder from fielding questions from journalists.

"Mariga : Yeah it’s sad because I am a registered voter and they can’t find me in the register, so as mheshimiwa said, we will wait for the verdict . Journalist : So when did you register ? Khalwale : Thank You that’s enough , that’s enough bro!" wrote Junior.

Earlier, advocate Omwanza Ombati had also ruled out Mariga on technical grounds. He said that the only official register is the one used in 2017 since the current one is yet to be adopted.

"It's a technical case. He registered three weeks ago. His name hasn't been adopted as a voter in compliance with the law. Adoption takes time. He will be locked out," he says.

Further, Ombati adds, should IEBC ignore that fact, still Section 36 of the Registration Act of 2016 will have Mariga knocked out of the race.

"Assuming he gets away with that, now that his name isn't in the register, revision needs to be done. By law, he will have to wait until November 18th to be cleared," he added.
