Digital taxi service provider Uber issued a statement on Thursday over allegations levelled against one of their Mombasa-based driver alleged to have sexually assaulted a 13-year-old boy.
Fredrick Mungai Njenga is alleged to have forced the boy to lick his private parts as he drove him home from school in Nyali. The company has since distanced itself from the act.
“This would be a clear violation of our community guidelines. We take any incident of this nature very seriously and in cases like this, we immediately remove the driver’s access from the app,” the statement reads.
The 35-year-old Njenga was arrested at City Mall on Tuesday after the boy's mother filed a complaint with the police.
Uber has promised to offer all the necessary aid within their ability to concerned parties in the case.
“We are in contact with law enforcement to assist their investigation in any way we can," they promised.
However, Njenga was temporarily off the hook after Senior Resident Magistrate Yusuf Shikanda stated that the law does not recognise the mouth as a genital act invalidating the 'indecent act' allegations. He appeared before the Shanzu Law Courts but Shikanda ordered rewriting of the charge sheet.
“According to law, it is not “indecent act” since the mouth is not a genital organ. Get a proper charge,” the magistrate told the prosecution.
