Director of Public Prosecutions (DPP) Noordin Haji has moved to court seeking to block lawyer James Orengo from acting for embattled Kenya Ports Authority (KPA) boss Daniel Manduku.
Mr Haji, according to a tweet by NTV argues that the Siaya Senator has a conflict of interest in the matter, this calling for his removal from the defence team.
Manduku and his team are accused of allegedly inflating costs of certain tenders that amounts to Sh2.5 billion, forcing DPP to investigate the claims.
But Mr Manduku, who has since procured the services of Orengo, maintains that he's being subjected to a witch-hunt by his destructors.
On his part, Mr Orengo said there is a procedure in parliament on how to deal with conflict of interest.
“Standing orders take into consideration provisions of the Constitution. As it is, there is no complaint made to Parliamentary Service Commission or the Speaker that they have breached provisions of the Constitution,” Mr Orengo argued in court as quoted by Nation.
Haji's application comes barely a week after President Uhuru Kenyatta took a swipe on the lawmakers representing graft suspects in court.
"One cannot serve as a legislator at the national or county level while at the same time practising law, whether or not for gain," Uhuru said as quoted by the Star.
The President said professionals who take state or public offices should give up a private practice and devote their full-time energy and focus on public duties without the perception that they are using their offices as a platform to advance personal interests.
"Is it fair? Is it right fo legislators who have control over funds and exercise oversight over the Judiciary to appear in court as counsel?" Uhuru posed.
