Police in Bondo in Siaya county are holding two Congolese men suspected to be illegally in the country.

The two; Jackson Kamiot and Asili Nyankozi were nabbed while hawking jewellery at Wagusu Trading Center in West Migwena Location, Bondo Sub County on Thursday.

Only one of the suspects had a passport, which allegedly expired last month while the other didnts have any documents, said area Assistant Chief William Oreme.

The chief said that the one with the passport claimed that he thought it was to expire in 2022, leading to the arrest and detention of both, aged 22 and 21 respectively.

According to Chapter 172 of the Immigration Act, a foreign national nabbed within Kenya and unable to produce their papers on demand or within the required time is taken as an illegal immigrant.

The law adds that such a person can be held in prison for a period not exceeding 14 days pending decision on the matter, in the instance that the court is told that the person has made an application to be issued with documents validating their stay in Kenya.

“Subject to this section, the presence in Kenya of any person who is not a citizen of Kenya shall, unless otherwise authorized under this Act, be unlawful,” reads the constitution.

The two are set to be arraigned in court.
