Ousted Kisumu County Assembly Speaker Onyango Oloo has kicked off attempts to recapture his seat, weeks after Members of the County Assembly (MCA) kicked him out.
In a Certificate of Urgency application filed at the Labour and Employment Court, the former Kisumu Central parliamentary hopeful wants six court orders issued by the court.
He wants the court to overturn his impeachment, which saw him replaced by Elisha Oraro, and reinstate him as the County Speaker, a position he ascended to after the 2017 polls.
Oloo argues that his impeachment was uncosntitutional, and wants the court to halt its implementation until his new suit is heard and determined.
The former The National Alliamce (TNA) party Secretary-General also wants another court order to enable him enjoy the privileges and allowances he has always enjoyed as Speaker.
“The county assembly illegally removed me from office without affording me an opportunity to defend myself and respond to the allegations raised against me,” he says in the application.
He says that the September 18 ouster came without him not being given an opportunity to defend himself, arguing that Oraro's election goes against article 178(1) of the constitution.
This, he has based on the fact that Oraro remains a member of the county assembly. And is also accusing police from Kisumu Central Police Station of helping bar him from office.
“They were aided by police, hired goons and some MCAs. Additionally, the assembly limited my right to a fair hearing, "he adds.
