The interior Ministry has been handed a major blow after the Public Procurement Administrative Review Board (PPARB) blocked the signing of the tendering deal for the police cars.

The Fred Matiang’i-led ministry is now expected to go back to the drawing board after PPARB halted the process following the complaint from CMC Motors opposed the progress of the matter.

Section 168 of the Public Procurement and Asset Disposal Act of 2015, highlights that any pending application stops the tendering committee from continuing with the same. 

The matter will be put on hold until the court determines the same. The matter will be heard on October 23 before High Court Judge John Mativo. 

CMC has asked the court to throw away the tender issued on the leasing of the motor vehicle. The firm argues that the process was null and void.

“That an order be issued declaring all the actions undertaken, including but not limited to advertising, inviting, receiving, evaluating bids awarding and/or signing of contracts arising from tender No. MICNG/SDI/004/2019-2020 for leasing of motor vehicles phase from assemblers is null and void and the same be cancelled,” the application read in part, as quoted by Standard. 

CMC’s lawyer Migos Ogamba, told the court that the tender award was not undertaken in accordance with the legal procurement. 

The company has now accused the ministry of being biased in its management.
