Kiambu County Governor Ferdinand Waititu is set to spend another night in custody even after being freed.
Waititu will spend the third night at the Industrial Area remand prison after failing to process his bail in time.
His wife, Susan Wangari will also spend the night at the Lang'ata Women’s Prison.
On Tuesday, Milimani Anti-Corruption Chief Magistrate Lawrence Mugambi freed him on a cash bail of Sh15 million or Sh30 million bond after denying corruption charges over a Sh588 million irregular tender.
In his ruling, Justice Mugambi has banned Waititu from his office.
“It is necessary to guard the risk of interfering with the witnesses in the case by imposing conditions…restricting him is necessary and to ensure the public interest is safeguarded,” he said as quoted by Citizen.
“I agree with Justice Mumbi Ngugi decision. It is a decision that dealt deeper with section 66 it’s persuasive and authoritative…Barring him from going to office does not amount to his removal from office as a governor but uphold the integrity of the case,” the magistrate added.
Waititu was charged alongside his wife and other county officials.
However, the court noted that their position will not be declared vacant until when the case will be decided.
