The prosecution is set to file a formal application that will bar Elgeiyo Marakwet Senator Kipchumba Murkomen and his Makueni counterpart Mutula Kilonzo Junior from representing Nairobi Governor Mike Sonko in court.
The prosecution through its lawyer Joseph Gitonga made their intention clear on Wednesday after Magistrate Douglas Ogoti granted Sonko bail.
According to Gitonga, the two senators are in conflict of interest.
“We will file a formal application seeking to block senators present in this court from addressing the court in this matter,” he stated.
The sentiments came shortly after Murkomen appealed with the court to offer Sonko protection against any impending arrest.
There are also two Members of Parliaments on Sonko's legal team. The two include; Daniel Maanzo for Makueni and Ben Momanyi for Borabu.
Further reports indicate that the following lawyers among others are also part of Sonko's legal team; Cecil Miller, Nelson Havi, George Kithi, Alphonse Mutinda, Osundwa Michael, Harrison Kinyanjui, Kwanga Mboya, and Felix Kiprono.
The case was will resume on January 15, 2020.
Governor Mike Sonko was arrested on December 6 after a directive from the Director of Public Prosecution Nordin Haji. He was nonetheless released on a cash bail of Sh15million on December 11 after spending 5 days in police custody.
Sonko is linked to a Sh357 million graft case. Other charges against him include resisting arrest, assaulting a police officer among others.
