A court sitting in Nairobi on Thursday declined to issues orders barring Kiambu Deputy Governor James Nyoro from taking over.

Embattled Kiambu Governor Ferdinand Waititu had moved to court seeking orders to block Nyoro's from taking over.

According to Citizen Digital, the court instead directed for interparty hearing on February 3rd thus giving Nyoro a reprieve.

Waititu had named Kiambu Assembly, Speaker and Dr James Nyoro as respondents in his application.

Earlier, there were plans to swearing-in Nyoro but Judiciary called off the function, although no specific date was given.

Waititu was impeached by the Senate on Wednesday, paving way for his replacement. However, he has since moved to court.

Senator Samson Cherargei is among those who have already hailed Justice John Onyiego for not swearing-in Nyoro.

"Thank you judge Onyiego for standing with justice by not participating in an illegal swearing of kiambu Deputy Governor @james Nyoro . This was going to be travesty of justice!" he said.

Senate Speaker Kenneth Lusaka confirmed gazettement of Waititu's impeachment, paving way for changes in Kiambu.

"I signed off a gazette notice after the vote was taken," Lusaka told the Nation on Thursday morning.

"As to whether it has been published, I really can't say. But, yes, I signed it," he added.
