An 18-year-old man has been sentenced to life imprisonment after he was found guilty by a Kisumu Court of sexually assaulting his seven-year-old niece.
Senior Resident Magistrate Angeline Odawo heard that the teenager committed the crime on March 1, 2017, at an estate near Kisumu Airport.
The accused person was facing two charges of defiling the minor and incest.
The mother of the girl told the court that the young man was an orphan and was living with her family.
On the material date, the mother said she had a disagreement with the accused person and on that night, March 1, 2017, she was shocked to find her daughter naked.
The court heard that the mother woke up to go to the washroom and decided to check on her two daughters who were sleeping in their bedroom and was shocked to find one of her daughters naked.
She immediately suspected that she was defiled while sleeping.
The girl who was in Class Two at the time was taken to the hospital for medical tests where it was confirmed that she had been defiled leading to the arrest of the teenager on March 5, 2017.
During the case hearing, the accused person admitted to committing the crime and in mitigation pleaded with the court to forgive him saying he was an orphan and was taking care of his old guardian.
The Magistrate in her ruling found the accused person guilty saying the prosecution has proven its case beyond a reasonable doubt.
“I have considered the nature of the offence and the accused's mitigation. I proceed to sentence the accused to life imprisonment,” ruled Odawo as quoted by Standard Digital.
