A man in Homa Bay county was on Tuesday arraigned in court to face charges of defilement.

The court was told that Mr Nicholas Ogutu Odoyo defiled his daughter in her mother's house on October 26, before he was arrested by the police on Saturday last week and detained.

He was arraigned before Ndhiwa Principal Magistrate Mary Ochieng, who heard that the crime was committed on the 11-year-old at Kombe village in East Kochieng Sub Location.

He is said to have taken advantage of his separation with his wife to sexually assault the class six pupil, before he was given away by villagers who caught wind of his actions.

The prosecution also charged him with committing incest, with the magistrate being told that his actions contradict doctates of the Sexual Offences act of the constitution.

However, in his defence, the accused denied the charges before the court and was released on a Sh200,000 bond, as is reported by the Kenya News Agency.

Magistrate Ochieng set November 11 as the date when the case will be mentioned, before being heard on February 24, 2020.

In Kenya, sexual crimes fall in the list of capital offences, which can hand a person a sentence of up to life imprisonment if found guilty.
