A man might spend his entire life in Prison after he was found guilty of robbery with violence on Thursday.

Mr Ezekiel Fedha was arraigned before Isiolo Principal Magistrate Evanson Ngigi and charged with committing the crime on August 28 2016, at Mwangaza area.

He was sentenced to death, after the judge agreed with the prosecution that he robbed Francis Mburuki, a bodaboda rider, of his mobile phone and Sh250 on the said day.

In his testimony, the 29-year-old added that the convict also took away his motorbike, after posing like a customer, only to turn against him along the way, and assaulted him in the process.

“It was around 7pm when the accused found me with two others at Nyara stage and asked me to take him to Isiolo Academy. 

"He attacked me while on the way, walked away with the motorbike and left me for the dead by the roadside,” he said.

He claimed that the accused hit him with a crude weapon, injuring him on the head, but was rescued and rushed to the Isiolo Referral Hospital before reporting the incident.

He added that the convict later told him that he sold the motorbike in Kitengela when he confronted him demanding it later.

Mr Fedha who was arrested eight months after the incident pleaded with the court for leniency, arguing that he has been in remand for too long, an argument the judge dismissed.

“I have considered the mitigation by the accused and the fact that he is a first offender but find death sentence as the most appropriate owing to the aggravating circumstances. I accordingly sentence the accused to death penalty,” he said.

This could translate to life imprisonment, given that hanging is no longer practiced in Kenya.

Mr Fedha was given 14 days to appeal the ruling.
