Renowned lawyer Nelson Havi has weighed in on the ongoing debacle surrounding the nomination of Mwende Mwinzi as Kenya's ambassador to South Korea.

In a tweet on Sunday, the lawyer held the view that it was the constitution that prevents Mwinzi from taking up her new job.

He called on the rule of law to be upheld in the matter and not the opinions of politicians whom he disparaged as noisemakers.

Parliamentarians have charged that the nominee cannot take the diplomatic job unless she renounces her American citizenship which she is adamant to renounce.

"It is The Constitution of Kenya which precludes Mwende Mwinzi from being an ambassador on account of her dual citizenship. It is not a matter to deliberate over or rationalize. Let the National Assembly uphold the rule of law without hindrance from misinformed noise makers. ^DoS," Havi's tweet read.

Mwende Mwinzi was cleared to be Kenya's ambassador but her dual citizenship remains a matter of deep concern to legislators who vetted her.

The speaker of the National Assembly Speaker Justin Muturi had called for a probe a few weeks ago to establish whether she had renounced her citizenship with Foreign Affairs Cabinet Secretary Monica Juma saying that she was not aware whether the renunciation had happened.
