A section of Kenya National Union of Teachers (Knut) officials who have been pushing for the ouster of Secretary General have accused the SG of lying to the court to get a reinstatement.

The latter was earlier in the week reinstated by the Employment and Labour Relations Court, only a day after the Knut top organ ousted him on Froday last week.

The announcement was made a day after the National Executive Council (NEC) proposed his exit, accusing him of working in solitary.

Through his lawyer Okong'o Omogeni, his deputy and acting SG Hesbone Otieno on Wednesday told the court that Sossion added the Registrar of Trade Unions in his application though she was not party to the case.

The lawyer said that the ODM nominated MP managed to fool the court by adding the name of Elizabeth Gicheha after his removal, and Justice Helen Wasilwa reinstated Sossion basing on an old court order, after being fooled.

“There was an order you gave on the basis that there was an order that was disobeyed. On the face of it, it is totally misleading. You were misled. The order was effected on August 30,2019. By the time this order was being served, the meeting had already taken place on August 29, 2019,” he said.

The lawyer warned that the judge might find herself in a funny situation soon should she not correct the mistake she committed after being misled.

The Nyamira senator claimed that Sossion basically went for the court order to paralyze operations at the union.

"That is obtaining an order through fraud. You cannot obtain an order on a party who was not a party to this proceeding. One person has paralysed all the operations of an organisation. He sued everyone in Knut. You were misled that if you do not give orders that the finances of the respondent will be in jeopardy,” he added.

Speaking after his reinstatement, Sossion who had vowed not to leave, blaming his ouster on some top state officials out to victimize him, extended an olive branch to his rivals.
