Nairobi businessman Humphrey Kariuki on Wednesday was dealt a major blow after a court-ordered for the retention of his travel documents pending probe into tax evasion claims.
The businessman is now walking tight rope after an earlier directive on the release of the passport was reversed.
Magistrate Kennedy Cheruiyot has asked the tycoon to make another application for the release of the documents before he can travel out of the country.
Cheruyoit, who had allowed for the release of the passport, has now directed the businessman to reapply for the same under the case 1333 of 2019.
The magistrate had ordered the police to release the billionaire’s passport with immediate effect on Thursday before the turnaround of events. Kariuki was unable to secure the passports after it emerged that the court files could not be accessed during the hearing of the case.
On Friday, Kariuki, through his lawyer Cecil Miller, said that the order of the Director of Public Prosecutions (DPP) was against the law. Kariuki has been facing tax evasion charges for weeks.
DPP Haji has repeatedly said that he has enough evidence against the tycoon as far as tax evasion is concerned. The businessman has accused DPP Noordin Haji of witch-haunt in the case against him.
