100-years-old Esther Wangui told the court that the four bedroom house that sits on a half-acre parcel of land in Njoro belongs to her.

In the suit filed by his son, John Gakure, the court heard that the house which her late son’s wife, Jelioth Wanjira is claiming ownership was bought by her children who gifted it to their mother.

Gakure, through lawyer Njuguna Matiri, told the court that Wairegi suggested that the siblings contribute money to purchase the property with an aim of resettling their elderly mother.

“It is clear from the correspondence that the intention of the purchase was to gift my mother a house and land,” said Gakure as quoted by nation.co.ke.

Gakure wants the court to issue orders restraining Jelioth from disposing, interfering or evicting their mother from the house.

The daughter-in-law, Jelioth, has however claimed that the house which is in her name she co-purchased it together with her late husband.

Jelioth said that her brothers-in-law want to disinherit her by using their mother’s power of attorney adding that their mother might not be aware of the court case.

While denying claims that she procured registration as the sole owner of the property, Jelioth said after her husband’s death in 2011 she became the sole owner of the property.

“I have not committed any civil or criminal wrong in having the land registered in my name because I did the same legally in accordance with the existing laws in Kenya,” she said.

The case will be heard on February 7, 2020.
