President Uhuru Kenyatta has broken silence on why he is yet to gazette the 41 judges selected by the Judicial Service Commission.
The head of state has said that he received information that tainted the image of some of the judges, which had made him not to reconsider the list.
He also said that he will be unfair to elevate judges with integrity concerns.
Uhuru has now said that he will consult the relative authorities to allow them take an action against the judges before he makes his final decision on the same. The remarks of the president come four months after he was presented with the names of the nominees for consideration.
The silence of the President prompted one of the lawyers to file a case in court seeking to compel him to respond to the same with immediate effect. On Tuesday,Head of Public Service Joseph Kinyua moved to court to file an affidavit on behalf of Uhuru in regard to the case.
“The President received adverse reports in respect to some of the persons recommended for appointments as judges after the names of the said judges were published in the media. The President believes that the Judicial Service Commission ought to have considered the information while arriving its recommendation,” the reply reads, as quoted by Standard
Uhuru also said that it would be contrary to his oath of office as the President to give judges with integrity issues a green light to assume office. The president is collating information on the nominees in consultation with different legal authorities before he approves the same.
