A Nairobi Labour Court on Monday suspended a gazette notice from the Teachers Service Commission (TSC) that deregistered the Kenya National Union of Teacher (KNUT) Secretary-General Wilson Sossion.
According to the court, a case already filed should be heard and determined before the deregistration.
This comes barely a month after the TSC boss Nancy Macharia released a notice that banned Sossion from being a teacher, thus barring him from teaching in any school across the nation.
“Pursuant to section 30 of the TSC Act, the Commission has removed the name of the individual named hereunder (Sossion) from the Register of Teachers. Further, under the law, the individual cannot engage in teaching in any school,” read the gazette notice.
This case was battled out between the TSC lawyer Timon Oyucho and Wilson Sossion's lawyer Paul Muite before Justice Stephen Radido of the Employment and Labour Relations Court.
Oyucho told the court that TSC boss Nancy Macharia's name should be removed from the case, while Muite noted that she is the one who gazetted the notice thus her name should be in the case.
The justice ruled out that the deregistration should be set aside until the case is determined.
He reinstated the KNUT boss back to the TSC register.
Sossion's issues started when he was nominated to parliament by Orange Democratic Movement (ODM) party.
