A court in Eldoret on Thursday ordered that Eldoret West OCS be detained for contempt of court.
The OCS Solomon Wamae was charged with contempt of court after he defied the court order of producing suspects in court.
While defending himself, the OCS said he did not take the two suspects to court because the case was handled by a multi-agency and the County Police Commander was the one in charge.
He added that investigations were ongoing being the reason behind not presenting the suspects to court.
The suspects had been arrested on Monday for being accused of smuggling cigarettes from Uganda worth over Sh10 million.
In his ruling, Eldoret Chief Magistrate Linus Hassan said that it was against the law for the OCS not to comply with court orders.
“The OCS did not comply with the court of law. The rule of law is under threat since he is mandated to ensure court orders are complied and that despite the charge sheet for the two persons being ready, they were not presented to the court,” said Hassan.
“I order that the OCS be detained until the suspects are brought to court,” he added.
The two suspects have been in police custody since Monday this week and have not been taken to court.
According to the Constitution, any arrested suspect is supposed to be taken to court within 24 hours.
