High Court Judge Justice Weldon Korir has said his order regarding lawyer Miguna Miguna's return to Kenya is still in force.
Appearing before Justice Korir on Wednesday, Miguna's lawyer John Khaminwa said he had spoken to Interior Cabinet Secretary Dr Fred Matiang'i, who assured him that the State is not against Miguna's return.
On their part, the state said Miguna had been cleared to return to the country, adding that they don't understand why he has not been able to travel.
On Tuesday, Miguna was barred from boarding a plane in Germany, over a red alert that had reportedly been issued by the government.
In view of the above, Justice Korir noted that his order issued last week regarding Miguna's return was still in force, and should be adhered to.
Last week, the judge directed the state to ensure Miguna gets unconditional access into the country.
“An order be and is hereby issued, that pending and following the inter-partes hearing of the application, compelling the respondents to facilitate entry of the Petitioner into Kenya on January 7, 2020 or any other date appointed by the Petitioner on the basis of his identification through the use of his National Identity Card, or his Kenya Passport in the form and state it was delivered by the respondents to the High Court registry pursuant to this court’s order,” the order read as quoted by Citizen.
