The supremacy battle between the National Assembly and the Senate escalated on Thursday as senators made good on their threat to have the battle adjudicated in court.
Speaking in the High Court, Tharaka Nithi Senator Kithure Kindiki tore into MPs, branding their behaviour rogue and primordial.
"There exists real danger of the country being thrown into a crisis, not only by the executive, but by part of the bicameral Parliament in the name of a National Assembly that behaves rogue, that behave in what I can call primordial activism that threatens the rule of law that the country is famed for, " Kindiki fired in a YouTube video shared by Daily Nation. The Senate Deputy Speaker also strongly challenged 20 laws passed by the National Assembly touching on counties without the input of the Senate, arguing that senators are obligated to contribute to laws passed by the National Assembly that affect the 47 devolved units.
Kithure's submission comes in the wake of a worsening standoff between Members of Parliament and Senators.
The two have bitterly clashed over their roles and the position they occupy in the Parliamentary pecking order, a rivalry underpinned by the constitution's perceived silence on the matter.
Senators led by Speaker Ken Lusaka and the chairman of the Legal Affairs Committee Nandi Senator Samson Cherargei have filed 20 petitions at the High Court.
