Family of departed Kisumu Court of Appeal judge Justice Otieno Odek on Tuesday opposed plans to fly his body to the Lee Funeral Home in Nairobi, from Kisumu.

The plans to have the body taken to Nairobi had been arranged by judicial officers, but the family opposed the move, arguing that they had not been consulted.

The late Odek's elder brother Yonah Odek, said it was agreed that the body be returned to the Aga Khan Mortuary from the Kisumu International Airport, where it was ready for departure.

"We realised when his colleagues, families and relatives wanted to view the body. After consulting, it was decided that the body be brought back to Aga Khan Hospital mortuary,” he said at the hospital on Tuesday.

He noted that the judicial officers made the move without being aware that of the presence of his relatives in Kisumu. 

According to Yonah, his late brother  will be buried in Asembo, Siaya.

"We will communicate any plans including postmortem exercise and burial later,” he added, in the company of Anne Achieng', the widow of the deceased.

Justice Odek was found dead in his apartment in Kisumu on Monday, with detectives investigating the cause of his death.

A pathological test is set to be carried out on his body as part of the investigations.
