Nairobi businessman Francis Mburu has filed a new suit where he is demanding to be paid a total sum of Sh36 billion for his 13-acre piece of land in Ruaraka, Nairobi County.
Mburu through his companies Huelands Limited and Afrison Export Import Limited is accusing the government of illegally taking his land away from him.
He wants Sh23 billion as compensation and a further Sh13 billion for loss of rental income for the land where Ruaraka High School and Drive Inn Primary School have been built.
He also wants to be paid the accrued interests, with his suit intended to convince the court to issue an order to compel the state to compensate him to the tune he is demanding.
In the suit, he has sued the Attorney General, National Land Commission (NLC) and Nairobi County Government, which he says is enjoying land rates, rents and premium from his land.
He also wants the Attorney General held accountable for failing to protect him and the land, only two months after a 3-judge bench ruled that the land was state land from the beginning.
The tycoon has since appealed the ruling and wants the Sh1.5 billion he had received from the government be deducted from the Sh36 million he is seeking should he lose the appeal.
