President Uhuru Kenyatta’s nominees to the National Land Commission (NLC) will have to wait longer to know their fate after the High Court halted the process of swearing them into office.
Citizen Digital reports that the nine nominees will remain out of office until a case against them is heard and determined in accordance with the constitution before they can assume their new roles.
The case has been filed by activist Okiya Omtatah who has objected the nomination, saying that they didn’t comply with the constitution of this country.
Uhuru had appointed Mr. Gershom Otachi (NLC chairman), Mr. Kazungu Kambi, Ms. Gertrude Nguku, Mr. Reginald Okumu, Ms. Esther Murugi, Ms. Hubbie Al-Haji, Prof. James Tuitoek, Mr. Alister Mutugi and Ms. Tiyah Galgalo.
The members of the commission had been approved by parliament but they cannot assume their new positions until the matter is settled.
Omtatah said that the process of appointment of the commissioners failed to adhere to the required standards.
He also told the court that the panel that oversaw the exercise is not only incompetent but also biased.
The Activist insisted that the members were supposed to be constituted in a procedural manner, which didn’t happen.
The commission will start operations once it has been sworn into office.
