For over four weeks, IEBC has been hesitant to release the register to the party, arguing that it will amount to invasion of privacy and breach of the law.

But through lawyer James Orengo, High Court Judge James Makau ordered the commission on Wednesday to release the register, few hours to the Kibra poll.

Chairman Wafula Chebukati had defended his decision to delay releasing of the register, adding that IEBC was strictly following the law.

"In compliance with the court order, the Independent Electoral and Boundaries Commission has released complete register for Kibra to ODM party," he said.

But without much elaboration, Mr Moturi said compliance of the court order by the Commission is a big win to all Kenyans moments after ODM received the register.

"The IEBC has complied with the dictates of the Court judgement in regard to the Kibra Voter Register. It is a win for Kenyans," Moturi said.

Over 118,000 Kibra people will on Thursday (today) elect the next MP, three months after the death of Mr Ken Okoth, a two-term ODM legislator.

ODM fielded Imran Okoth, Jubilee party went for former footballer McDonald Mariga while ANC picked Raila Odinga's former aide Eliud Owalo.
