Former Kisumu County Assembly Speaker Onyango Oloo has returned to court, in a bid to save his job.
Oloo was in September 2019 impeached by Members of the County Assembly, who based their decision on his implication in graft dealings and alleged abuse of office.
On Tuesday, Standard reports, he filed an appeal in court, arguing that he was unconstitutionally ousted by the members.
In his appeal, he also seeks to have an earlier ruling by the High Court annulled.
Onyango Oloo says that Labour and Relations Court Judge Nduma Nderi only upheld his impeachment on the basis of his ongoing corruption case at the Anti-Corruption Court in Nairobi.
In his appeal, he argues that the judge only considered "the sole ground of the corruption case the appellant (Oloo) was facing in the Milimani corruption case."
Onyango Oloo says that as a result, the lower court wrongfully dismissed his case, also faulting Justice Nderu for ignoring the fact that his impeachment was against Standing Orders and Procedures.
In the suit at the High Court, he had also said that he was not given enough time to defend himself, an argument that was also dismissed.
Onyango Oloo's attempts to recapture his seat come only days before the planned election to replace him, which has been slated for this Friday.
Among the contestants is acting Speaker Elisha Oraro, who has since resigned from his position as the Kisumu North Ward Representative.
