Teacher Service Commission (TSC) development modules do not conform with the law, the Labor Court in Nairobi has declared.

The new development is a big win for teachers who have strongly opposed the programme in the recent past. 

The court has now directed the commission to convene an urgent meeting with the different stakeholders to determine the appraisal tools adopted in December 2019. 

The programme was expected to roll out in January 2020 before the court’s declaration leaving the commission in a dilemma. 

TSC had adopted the tool as a way of monitoring the performance as well as the conduct of the teachers before the court ruled against it after strong opposition from the teachers. 

Teachers across the country believed that the move was meant to make their lives even harder while in pursuit of their careers.

They were expected to undertake professional courses on a continuous process to keep them abreast with different issues in the education section.

 “The Teachers Professional Development (TPD) modules in dispute shall not be implemented as they fall short of a professional development program. This court declares that notice of withdrawal of teachers dated December 2018 is set aside,” the ruling reads.

The teachers had vowed to continue opposing the move until the court ruled in its favour.
