A police file containing witness statements in the hate speech case against Gatundu South Member of Parliament Moses Kuria has been stolen, the Star reports.
The Director of Public Prosecution (DPP) has now been instructed by the Milimani Court to find out who made away with the statements.
The prosecution on Monday requested for 3 weeks to establish how the statements had disappeared.
“I, therefore, grant the last adjournment to allow the prosecution to put their house in order by establishing who stole the statements,” magistrate Kennedy Cheruiyot ruled.
DPP has until min January to establish how the statements from the witnesses disappeared.
Moses Kuria is facing hate speech charges following the remarks which were considered inciteful that he made on June 26, 2015, at Gatundu Stadium in Gatundu town.
He was charged on November 25, 2015, at the Nairobi court.
“If I get a person, you and that is why I said, you should come with your pangas, these pangas are not only for clearing, have you heard? A person like that you should slash and finish him,” Kuria allegedly stated according to court documents quoted by the Star.
The outspoken MP was charged afresh in July on allegations of incitement.
A separate Milimani court nonetheless dropped the charges levelled against him.
Chief magistrate Francis Andayi pointed out that the video which has presented as evidence was obtained from social media without any other supporting evidence.
