The High Court on Monday gave Foreign Affairs Cabinet Secretary Monica Juma two days to respond to a case filed against Mwende Mwinzi who is a nominee for the job of Kenya’s ambassador to South Korea.

The directive came after the Attorney General’s office informed the court that they have not received any communication from the office of the Cabinet Secretary on whether to represent and file submissions on her behalf.

In a report published by Citizen Digital, the Attorney General's office requested Justice James Makau to give them 14 days to file their submissions together with an application for the petition to be heard by a three-judge bench.

“The matter raises serious questions of law and 14 days will enable us get instructions on whether to ask court to refer the matter to the CJ to empanel a bench to hear the matter,” the court was told as quoted by Citizen Digital.

Mwinzi moved to court last month in a bid to seek a directive for Government send her to South Korea without requiring her to revoke her American citizenship. 

Members of Parliament have insisted that she must revoke her American citizenship before taking the ambassadorial job.
