The commission has revealed that it is considering demoting teachers who were promoted based on the career professional guidelines which were recently suspended by the court.

The new development will affect teachers from all over the country as the commission seeks to introduce new reforms in a bid to better service delivery.

The guidelines of promotion were suspended by the court last week thereby leaving the headteachers in a state of dilemma as they ponder over the next move by the commission.

The commission has said that it is likely to be compelled to return the teachers in their old job groups until 2020.  The commission also faulted the court for the suspension of the performance management tools.

According to TSC, the suspension of the guidelines will cause teachers not to be held accountable for the poor results of the students at different levels.

TSC boss Nancy Macharia said the ruling has negatively affected the education sector since teachers can do what they deem is right without bothering about the results received by the students at the end of the day.

“TSC herein is aggrieved by the judgment and is reasonably apprehensive that unless orders of stay of execution are immediately granted, the applicant shall be completely paralysed in executing its mandate under the Constitution,” she said, as quoted by the Nation.
