The Director of Public Prosecutions (DPP) Noordin Haji has said Governor Mike Sonko's nomination of Anne Mwendwa as Nairobi Deputy Governor is null and void.
According to the DPP, Sonko's move to nominate Mwendwa is a violation of his bail terms, adding that his office will move to court to challenge the same.
"The court was clear on what Sonko cannot do. To purport to have power to name a deputy while his case is still on is a violation of the bail terms given to him. We will move to court," he said as quoted by Star.
Earlier today, Sonko nominated Mwendwa to be Nairobi Deputy Governor, so as to lead operations at City Hall, as he battles his case in court.
"Given the foregoing, and in the interest of ensuring stability at Kenya’s capital city and largest county by economy and population, I do hereby nominate Anne Kananu Mwenda to the position of Deputy Governor,” Sonko said.
“The complexity in Nairobi became more intricate following my arraignment in court December 2019, and the subsequent bail terms that, among other things, require me, as governor, to stay out of office until the determination of the matter... I therefore humbly urge the Assembly to expedite the vetting process of the said nominee, for purposes of appointment, as per the provisions of the County Government Act...," his statement read in part.
Mwendwa is currently the Chief Officer Disaster Management in Nairobi County.
