The High Court in Nakuru has granted a Nakuru Catholic Bishop legal orders to manage an estate left by a priest following his death.
Justice Janet Mulwa in her ruling allowed Bishop Maurice Muhatia Makumba to execute the will of Father Peter Kabugi Mungai who had an estate valued at Sh60 million.
“Court summons for confirmation of grant of probate is hereby granted there being no opposition,” ruled justice Mulwa as quoted by the Nation.
Bishop Muhatia had filed the succession suit in March 3, saying that Bishop Kabugi left a valid written will dated October 10, 2017, in which he appointed Muhatia as the executor and trustee of his estate.
The court heard that Kabugi who died on November 7, 2017, had identified his parents Daniel Mungai and Lucia Wanjiku together with 29 seminarians of the Nakuru Catholic Diocese as beneficiaries of his properties.
Father Kabugi who left behind no child owns land in Nakuru, Ngata and Njoro together with accounts in NIC and ABC banks, a motor vehicle and shares in different companies.
Bishop Muhatia who vowed to observe the law while administering the estate told the court that his books, church vestments and sacred vessels will be given to the Catholic Diocese of Nakuru.
“I give half of my money whatsoever, all my immovable properties to my beloved parents Daniel Mungai and Lucia Wanjiku. All my land and half of all my monies I give to Ms Wanjiku. Catholic Diocese of Nakuru Seminarians to get half of the money at NIC Bank accounts,” read the will as quoted by Nation.
