A group of Russian nationals have been handed a one month jail term for working in Kenya without following the proper guidelines as per the Kenyan constitution.

The two, Dimitry Klimov and Semen Chirkov appeared before Kisumu Resident Magistrate Beryl Omollo on Thursday, where they were given an option of Sh100, 000 fine each.

The two were nabbed at the Presbyterian Daddy's Community Based Organization where they were working as volunteers, contrary to the citizenship and immigration act of 2011.

The judge threw out their lawyer Mourice Owuor's argument that they have a clean record and were harbouring a noble course, siding with the prosecution that they are offenders.

“The upshot is that the accused persons are found guilty for engaging in employment without being authorized by a work permit contrary to section 53(1) (m) as read with section 53(2) of the Kenya Constitution and Immigration Act 2011. The accused persons are convicted under section 235 of the criminal procedure code,” she is quoted by the Standard.

The two were arrested on June 14 after complains from members of the public who has spotted them at an orphanage in Dunga area.

The court established that Semen was in Kenya on a 3-month holiday visa on May 26, while Dimitry was was allowed in the country on a one month tourist visa.
