A city lawyer filed a suit against President Uhuru Kenyatta for failing to appoint judges in the recent recruitment exercise.

Lawyer Adrian Kamotho Njenga has asked the court to order President Kenyatta to appoint all the judges who qualified to be promoted.

He argued that the delay in the appointment is unlawful.  He has also filed a case against the Attorney General for failing to advise President Kenyatta on the appointment of judges.

In the case, Njenga has also listed The Judicial Service Commission and Chief Justice David Maraga among the respondents in the case.

He noted that the president is expected to appoint judges to the superior courts in the country but he is yet to do so even after the scheduled period expired. 

Njenga faulted the commission for failing to recommend candidates to Uhuru for appointment into different capacities. In the suit, he also alluded that 11 judges have since been considered suitable for promotion but the President has not responded accordingly. 

 “The indefinite delay in appointment of superior court judges recommended by the JSC is offensive to the proper administration of justice,” said Njenga, as quoted by Daily Nation.

He added: “It is in the interest of justice and sound public policy that the delay in appointment of person recommended as judges of superior courts be resolved at the earliest instance.”

The lawyer wants the case considered urgent to compel the head of state act with immediate effect for smooth service delivery.
